How to turn agricultural land into a residential land

Agriculture is one of India’s most important economic activities,  therefore regulations have been enacted to safeguard the country’s lush fields. Converting agricultural land to residential use is not allowed unless it is converted into non-agricultural property. If the owner wishes to use his farm property for an activity that does not fit within the category of agricultural activity, a proper legal process must be followed for converting agricultural land to residential land. Land conversion refers to the process of converting agricultural land into non-agricultural land.

According to the Madhya Pradesh Land Revenue Code (Amendment) Act, 2011, agricultural land can only be diverted for non-agriculture purposes with prior authorization from the state’s competent authorities.

What documentation is required?

Aside from an application, a slew of paperwork must be submitted to the relevant government. These documents are as follows:

  • Village form-8A extract
  • Mutation documents
  • Extract 7/12
  • A certificate of no objection (NOC) from the municipal council or gram panchayat.
  • A strategy for land usage.    

Owners can obtain certain land-related documents from the revenue department which keeps a record of such documents if they do not already have them. Along with all of these documents, the owner must also produce the survey map of the region, the project report, the receipt of payment of land revenue, and the portability of water certificates, etc.

Consider these points before converting agricultural land to residential in Indore.

  • In the computation of premium under the Madhya Pradesh Land Revenue Code, all land is considered irrigated agricultural property.
  • All dues and liens against the land must be paid before converting agricultural land to residential in Indore.
  • If the land in question is owned by more than one person, each owner must present evidence of identification as well as proof of ownership of the land.
  • The fee payment receipt must be stored carefully since it also serves as proof of conversion.
  • This document must be kept secure until a conversion certificate for the land is granted, and it should also be kept safe for reference purposes.
